3. Shipment and Payment conditions: Your individual product we ship only for paying in advance. Each special designs are barred from change and return. For delay in delivery because of force majeure or extraordinary circumstances, supply difficulties for example, we are not responsible. Even though we assure a binding date of delivery. In this case we are able to withdraw from the contract partially or completely.
4. Costs: The agreed prices, honoraria an payments include the sales tax to the tune of the effective percentage.
5. Guarantee: We guarantee, that the delivered goods are without failings of materials and fabrication. The customer commits itself, to check the merchandise immediately of amount and failings, otherwise the merchandise ist accepted. Failings have to tell in writing within one week. Failings, you find later than a week have to tell in writing, too. Returns of failing merchandise is to bring into agreement with us and you have to frankable it sufficiently. Returns without enouhg frankable we don't accept. Our guarantee confines on alternative, abatement or retification.
6. Conditional Sale: The delivered merchandise is our property until it is payed completely.
7. Liability: Our liability to the customer conform to the previous conditions only. Compensation claims from the customer are not accepted for delay in delivery, default, rectification or other commitments, when they don't based on intention. Our guarantee excludes indirect and direct disadvantages and depends on the merchandise value. The customer indemnifys us from all claims, even third persons, which were higher than in the previous conditions described.
8. Cancellation: The customer can cancel the contract accordant to §3FernAbsG within two weeks without statement. The cancellation have to tell in writing or to send the merchandise back. The period of cancellation is guilty when the customer get the merchandise. If the customer want to cancel the contract, he must have to send the merchandise back. The customer hast to frankable itself, excepting the merchandise is another one than ordered. The cancellation is not guilty for special and individual designs.
9. Attention: The links are checked, but we don't resume responsibility for them. The carrier from each side is is responsible himself for the side. We want to know you, that we don't have any influence to the webpages which were linked to our homepage. We are in a distance to the contents from linked webpages. 10.Miscellaneous: When parts of the conditions are cancelled, the rest of the conditions are the same at all. Every change is to tell in writing. |
